Settlement In Little Valley Fire

After several years, and an unsuccessful attempt by the State to have the Nevada Supreme Court intervene in the case, the Little Valley Fire matter has come to an end (pending approval by the Nevada Board of Examiners).

The State has agreed to pay $25 million – $15 million from the State’s excess liability insurer and $10 million from the State’s own coffers. This money will then be split between 105 individual landowners and several landowner insurance companies.

Still left unanswered is whether the State’s grossly negligent handling of an intentionally set prescribed burn qualified as a “taking” under the Nevada Constitution. Hopefully, we never have need to find out.
