Taking Nevada

Eminent domain, condemnation, infrastructure, and land-use regulation in the Silver State.

Pump the brakes on braking the pumps.

It is little surprise that Nevada has issues with water availability. In a growing state, water is the difference between life or death – especially in real estate development. With water infrastructure, having 400 acres of land near the Tesla Gigafactory can make you a very successful landowner. Without water infrastructure, you’ve got a lot of dirt.

So, the recent decision to pump the brakes on the water pumps by the State Engineer has caused a lot of consternation. And so, a developer is suing the State seeking to undo the moratorium against groundwater pumping.

And now we wait while it winds its way through the legal process.
